Astonishing Discovery #2

Today's second astonishing discovery is that a specialist resume website has cut-n-pasted a section of an old version of one of my CVs and is displaying it as part of a sample resume.

I updated that section years ago and it's much improved now in my current CV. I thought it was pretty dire before, myself.

They changed my name, so no credit in the slightest. I have become Arthur L Collins from Mumbai. The key bit about the astonishment is that I've never had anything to do with this website before.  I've never uploaded my CV to them and I can't see any connection between them and any organisation or company I have passed my CV on to.

I'm not the type of fellow to take up a copyright infringement case against them, but that doesn't mean I can't have a bit of fun with 'em. I am considering posting a few comments absolutely slating the quality of the sample CV and not holding back on how utterly dreadful the particular section in question is.

I am, however, quite interested to learn if any aspects of data protection and/or copyright have been infringed illegally.  There can be no doubt in the slightest that a significant section of the sample CV has been lifted word-for-word from my own and made available for the public to download.

Does anyone have any knowledge of this area of writing and the law?  (Alan P, this might be up your street, eh?) I welcome perspectives from any of you on whether what has taken place is illegal in any way, and/or on where I could turn to to establish a clear-cut ruling on it easily and for free?

    Well me and google found your CV. Breathtaking cheek - it's pretty distinctive; not much liklihood of chance use of the same words there. My guess would be that somebody from an organisation that you have sent it to has simply sold it on, or taken it with him/her when changing jobs. In which case, I would think there is a clear breach of both data protection legislation and copyright laws.

    No idea how you would proceed, but if it annoys you, a letter to the company '...I note that you have used an extract from my CV without permission...' might bring a reply.

    As for a definite legal view without the cost of a solicitor, how about the Citizens Advice Bureau? At the very least they would be able to provide guidance on the law, and possibly specialist help.

    Cheers, Athelstone. Turns out I'm not annoyed in the slightest, and I won't challenge 'em on it. Truth is that this sort of stuff goes on willy-nilly and completely unchecked now, especially in other aspects of the intermaweb. My interest here is to establish things like whether words on your CV are deemed differently from other types of writing. The presumption might be, for example, that CVs are written with the author's intention and desire that a wide audience of prospective employers see it. Therefore, as with advertising, the more it is reproduced, the better. And with agents now often augmenting them before passing them on to employers, resumes might fall into a different classification of writing, perhaps?
